Aviation Litigation

Aviation litigation usually involves pilots and the FAA. The National Transportation Safety Board investigates aviary accidents but has neither regulatory nor enforcement powers. The FAA, however, is a part of the Department of Transportation and issues and enforces laws. Litigation can be a part of any legal process but when it comes to aviation, it is more often attorneys who are going against the FAA and defending a pilot. In the case of accidents, if the FAA finds pilot error as the cause, it could very well bring about criminal charges. Since the occurrence of mechanical breakdown is just as common as pilot error, aviation litigation may just prove that the pilot was not at fault. Litigation is sometimes involved too in a case of a passenger who was part of an aviary accident. The system works a little differently in the case of the FAA and pilots so that is why there are lawyers that specialize in that litigation.
