I am in the middle of a Jet sale transaction and the buyer claims we withheld maintenance records. What should I do?

I’m in the middle of selling a jet for my business. Unfortunately, the buyer has stopped making his monthly payments. He claims our company withheld critical maintenance records at the time of the sale. We sold the jet “as is.” What should I do?

It would be wise for you to immediately hire a general business law attorney who has experience in drafting and negotiating aviation contracts. Move quickly so that your interactions with your buyer won’t become further complicated by additional non-payment. Your lawyer can help you correctly analyze the terms of your sales contract so you can begin pursuing every appropriate remedy against the buyer.

As long as you haven’t personally violated any terms of your contract with the buyer or committed any type of material breach of contract, you should have a good chance of prevailing in this matter. Read over your contract terms to see if you were required to turn over all maintenance records at the time of sale and if you can prove you actually did so.
